This Privacy Policy explains how Puncta AI collects and uses information, including personal data, you provide on our websites: Puncta AI ('Sites'). The Sites are collectively referred to as the 'Services.'

A. Registration and account administration:

  • To register your property and allow you and Puncta AI to administer and manage the Services.

B. Providing our Services:

  • To provide our Services, facilitate their performance, and improve the Services and Sites' content.

C. Analyzing the use of Services:

  • To analyze the volume and history of your use of our Services. The results of such analyses help us monitor and report your use of our Services to comply with our Terms of Service ('ToS') and Service Level Agreement ('SLA').

D. Customer Service:

  • To provide you with customer support and success services, respond to your requests, questions, and concerns, and engage in customer success communications when encountering unusual activities in the usage of Services.

E. Marketing/Communications:

  • To provide you with information you request, send newsletters, marketing communications, and updates about new products and services, or other news or offers that we believe will interest you. Where we use your personal data for direct marketing, we include an unsubscribe link. We may invite you to events or referral programs.

F. Media delivery services:

  • Certain Services allow you to deliver media to your end-users. Puncta AI accesses these media and uses automated systems to analyze them for security, fraud prevention, compliance with legal requirements, product development and improvement, research, and customer or technical support.

G. Analytics, improvements, and research:

  • To conduct research and analysis. We may share or disclose the results of such research in an anonymous, aggregated form. We also assess your business needs to determine suitable products and improve our Services and marketing efforts. We may invite you to participate in surveys.

H. Security, fraud detection, and prevention:

  • To prevent and detect fraud and other illegal activities. Puncta AI may use personal data for risk assessment and security purposes, including user authentication. For these purposes, personal data may be shared with third parties, such as law enforcement authorities.

I. Legal and compliance:

  • To handle and resolve legal disputes or complaints, regulatory investigations, compliance, enforce agreements, or comply with lawful requests from law enforcement.

If we use automated means to process personal data that produces legal effects or significantly affects you, we will implement suitable measures to safeguard your rights and freedoms, including the right to obtain human intervention.

Legal Basis

For purposes A to D, Puncta AI relies on the legal basis that processing your personal data is necessary for the performance of your agreement with us. If you do not provide the requested information, Puncta AI cannot register your property, allow you to use, administer, and manage the Services, nor provide customer service to you.

For purposes E to I, Puncta AI relies on its legitimate business interests to provide its Services, prevent fraud, and improve its Services. When using personal data for these purposes, Puncta AI will balance your rights and interests against its own. For purpose I, Puncta AI may also rely on compliance with legal obligations. Where required, Puncta AI will obtain your consent before processing your personal data for direct marketing purposes.

Data Sharing

To provide its Services, Puncta AI captures and stores information, which may include personal data, about you and your end-users, including:

  • Request headers
  • Data submitted to our API

Puncta AI may use the data derived from media uploaded by your end-users for:

  • Detecting MIME types
  • Delivering, converting, or otherwise processing media upon request

You can recover, modify, or delete your data from your Puncta AI account at any time. Puncta AI does not sell, share, or rent out data stored in your account, nor use it for purposes other than those outlined in this Privacy Policy.

By using our Services, you are considered the data controller within the meaning of the GDPR, and Puncta AI acts as a data processor. You are responsible for:

  • Making necessary declarations to the relevant data protection authority
  • Complying with all current regulations
  • Obtaining explicit consent from individuals when collecting their personal data
  • Ensuring your authority to use the personal data collected and refraining from unauthorized use

When using our Services to receive media from EU citizens, you must ensure your data pipeline complies with GDPR regulations. When receiving media from California state citizens (USA), you must comply with CCPA regulations. This includes signing the Data Processing Agreement provided by Puncta AI if applicable.

Data Security

Puncta AI prioritizes the security and integrity of information and personal data. We follow reasonable procedures to prevent unauthorized access and misuse of information, including personal data. Our systems and procedures protect and safeguard information, including personal data. Only authorized personnel access personal data in the course of their work.

In accordance with GDPR and CCPA, Puncta AI undertakes to take all pertinent precautions to preserve data security, including protecting it against accidental or unlawful destruction, loss, corruption, unauthorized circulation, or access, and other unlawful processing or disclosure.

Data Retention

We retain your information, including personal data, as long as necessary to enable you to use our Services, provide our Services to you, comply with applicable laws, resolve disputes, and conduct our business, including detecting and preventing fraud. Personal data we retain will be subject to this Privacy Policy.

Puncta AI does not commit to storing all your data indefinitely. You can access data as long as you hold an active account with us and for a period that varies depending on the data type and subscribed plan, but no longer than 12 months after closing your account. Data may be deleted at any time during active use of your account per the provisions set forth above.

Your Choices and Rights

We want you to control how your personal information is used. Under the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks, GDPR, and CCPA, you can:

Please ensure your personal information is complete, accurate, and current. Inform us of any changes by contacting support@puncta.ai. Your applications will be processed within 30 days. We may require proof of identity or authority with your application.

You also have the right to lodge a complaint with the data protection authority in your jurisdiction.

Cookies and Tracking

Puncta AI uses cookies to improve and personalize its Sites and Services and measure its audience. Cookies are files saved to your local storage when browsing the internet, particularly on our Sites. A cookie is not used to gather personal data without your knowledge but to record information on site browsing, readable by Puncta AI on subsequent visits.

As our business evolves, this Privacy Policy may change from time to time. If you want to see changes, access this Privacy Policy regularly. If we make material changes or changes that impact you, we will contact you before commencing that processing.

Material changes will be notified via our Sites or email at least three (3) business days before they come into force.

Privacy Shield Principles

Puncta AI complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including onward transfer liability provisions.

In compliance with the Privacy Shield Principles, Puncta AI commits to resolving complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints should first contact Puncta AI at support@puncta.ai.

GDPR

Puncta AI has committed to cooperating with the panel established by the EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) regarding complaints concerning data transferred from the EU and Switzerland.

Governing Law

The terms of this Privacy Policy are governed by and in accordance with the laws of the United Kingdom and, where applicable, the laws of the countries where our servers are located. Do not provide us with any Personal Data unless you consent to the application of UK law and, where applicable, the laws of the server locations, and to the use and disclosure of your information in accordance with this Privacy Policy.
